Identification of Disputed Marine Areas in the Spratly Islands Area: A Starting Point for International Governance Lecture by Xuechan Ma Grotius Centre for International Legal Studies, Leiden University 13 January 2018, 3:15 p. m. Room 3.07, Institute of East Asian Studies, University of Cologne This presentation investigates international governance of disputed marine areas especially in respect of the regulation regarding unilateral activities and future cooperation. Moreover, the Spratly Islands area is used as an example to show how such international governance can be applied to a specific case. It will be addressed how to identify the existence and geographical scope of a disputed marine area. In terms of the Spratly Islands area the 2016 arbitral award of the Philippines v. China case may invalidate some claims alleged by States parties to the maritime dispute and thus have an impact on the identification of both the existence and geographical scope of disputed marine areas. Xuechan Ma is PhD candidate and a staff member of the Grotius Centre for International Legal Studies at Leiden University. She holds LLB and LLM degrees from Peking University. She worked as a legal intern with Judge Liu Daqun at the Appeals Chamber of the International Criminal Tribunal for the former Yugoslavia.

Chinese Courts’ Adjudication of Disputes Arising from Corporate Contracts Giving Security: A Comparative Critique Lecture by Dr Charles Qu City University of Hong Kong Law School 7 December 2017, 4 p.m. Room 3.07, Institute of East Asian Studies, University of Cologne One of the challenges that courts may face is how to adjudicate where no governing legal norms exist. An example of a legal lacuna, in the context of Chinese company law, is the absence of rules providing for parties’ rights over transactions giving security entered in the name of the company without authority. The lack of legal norms governing the above mentioned situation raises a question on the ways in which Chinese courts have allocated risks for corporate security contracts where the debtor defaults and the justifiability of the outcomes of the courts’ decisions in both doctrinal and policy terms. Dr Charles Qu holds an LLB and an LLM from the University of New South Wales and a PhD from the Australian National University. He is an Associate Professor at the City University of Hong Kong Law School. Dr Qu researches in, among other things, corporate law, corporate insolvency law, and Chinese corporate law.

The Virtual Currency Movement: Disruptive Potential and Regulatory Responses in Hong Kong, China, and the Asia-Pacific Region Lecture by Dr. Claire Wilson Department of Law and Business, Hong Kong Shue Yan University 26 October 2017, 4 p.m. Room 3.07 Institute of East Asian Studies University of Cologne The use of virtual currencies is increasing rapidly, presenting a number of potentially disruptive effects. This research focuses on the ensuing legal implications and highlights how regulators are responding to the rise of virtual currencies, with a particular focus on China, Hong Kong and countries in the Asia-Pacific region. Although the research finds that there is an increasing trend among jurisdictions to regulate – it highlights some ways in which the regulatory responses to date lack consistency. Dr. Claire Wilson is the Head of Department and Associate Professor of the Department of Law and Business, Hong Kong Shue Yan University. Her research interests traverse areas of Banking Law, International Investment Law, Finance Law and legal issues related to financial crime, particularly Money Laundering.

Are Securities Regulators Biased? Empirical Evidence of Securities Enforcement Actions in China 1998–2016 Professor Chao Xi Faculty of Law, The Chinese University of Hong Kong 20 July 2017, 6 p.m. Room 2.05, Institute of East Asian Studies University of Cologne Little is known about the biases, if any, of the primary Chinese securities regulators, viz., the China Securities Regulatory Commission, the Shanghai Stock Exchange, and the Shenzhen Stock Exchange. This research draws on a unique, hand-collected dataset on all disclosed securities enforcement actions, both formal and informal, taken against securities violations by the Chinese securities regulators during the period from 1998 through 2016. It offers a glimpse into the intensity of securities enforcement actions, both market-level and firm-level, in China. It also sheds important light on the determinants of Chinese securities enforcement practices. It shows empirically that firms that are larger in size, firms that are controlled by the state, and firms that characterize with a higher level of political embeddedness, and firms that cooperate more closely with the securities regulators are less likely to be targeted and, when they are targeted, they are more likely to fare better. A somewhat counter-intuitive finding of this research is that a closer personal bond with the securities regulators are likely to reduce the severity of enforcement actions, but are unlikely to minimize the likelihood of being targeted in the first place. Chao Xi is Professor of Law and Vice Chancellor’s Outstanding Fellow of the Faculty of Law, The Chinese University of Hong Kong (CUHK). He specializes in comparative corporate law, securities regulation, and financial regulation, and has published extensively in leading peer-reviewed international journals. Dear all, we, the ECLS Young Scholars, are happy to announce our first Young Scholars Workshop which will take place on 23 August 2017, the day before the 12th annual conference of the European China Law Studies Association (ECLS) in Leiden. The workshop will consist of two parts which will take place during the afternoon (the exact schedule will be published in due time). One part will cover questions about how Young Scholars can enhance their personal academic profile using Social Media but also via traditional channels, while the second part will focus on the topic of future developments of Chinese law in the bigger context of politics and the Chinese state. We are very honoured we got Rogier Creemers, Leiden University, Flora Sapio, Australian National University, as well as Larry Backer, Pennsylvania State University, on board for this workshop.
