The future of Waverley: There will be an election on 9th September this year of either Waverley as a stand-alone Council or a merged Eastern Suburbs council. Which one now depends on the 12th May hearing of Woollahra Council's leave to appeal. The leave to appeal will be either allowed or dismissed. If it is allowed Waverey will not be merged for many months; enough to run into the September election un-merged. It is now likely that the recent Ku Ring Gai Council court judgement will have bearing on the outcome of the leave to appeal judgement. We should all know that the Liberal State cabinet secret KPMG report was pivotal in the Ku Ring Gai judgement. There was another element to the court’s decision that is solely relevant to Ku Ring Gai but KPMG applies to all the mergers. Importantly for us in Waverley, the court found that the Delegate failed to fulfil his statutory function under the statute absent the KPMG report (at point 4) and that Ku Ring Gai council was denied procedural fairness (at point 5) because it was denied access to the KPMG report. A lot now hangs off the Woollahra decision on or soon after 12 May. John Wakefield
