I am pleased and excited to announce that, from 1 July 2016, Renee Eglinton will be joining my practice as a Legal Practitioner Director. Renee is an extremely experienced personal injuries lawyer having worked in the field since 1994 including time as a partner of a national firm and as an in house solicitor. She took excellent care of my clients when I was on maternity leave and I have had the opportunity of working with and opposite her throughout the course of my career. While her CV reads like a dream, what it can’t tell you is that she’s also a lovely warm person who is as gentle with her clients as she is ruthless with her opposition. I will continue to personally manage all of my existing claims and I will progress them as quickly as possible. Renee is available for appointments with new clients after 1 July. To reflect our expanding firm, we will be re-branding as kare lawyers

Why do hot water systems always conk out mid winter? Trying to look at it as a valuable life lesson about what it's like for my clients - losing something you take for granted. Unfortunately right now I'm too busy with selfish feelings - cold, poor and put upon. Ask me next week after a nice hot shower

WorkCover online system - Household worker insurance policy

Everyone in Queensland should hold a domestic WorkCover policy. I have no financial interest in you getting a policy. I am not on commission from WorkCover and my clients will be paid whether you have a policy or not. This entirely a community service announcement. Even if you don't have a cleaner, babysitter, nanny or gardener, you never know when you might get someone around to help with moving house, take a look at your leaky tap, fix your fence etc. You might not think you are employing them. You might not be paying them. You just don't want to risk being hit by a big bill if they are injured and claim to be a "worker" as defined by the Workers Compensation and Rehabilitation Act. Especially not when the cost of a domestic WorkCover policy is tiny (about $60 for 2 years!) So please - spread the word with all your friends and family. Make sure you have a domestic WorkCover policy. Here is the link. https://ols.workcoverqld.com.au/ols/public/newBusiness/hhw.wc

This morning I'm talking to Preppies about the law of torts. It's a compensation system and not about punishing the person at fault. In calculating compensation we look at where someone would be financially "but for" the injury.

I met some lovely new clients this week going through tough times. I fully understand when my clients are not happy and let their frustration out on me. Those clients who can see through their pain and recognise that I'm on their side really give me a lift. Over the years I've received flowers, chocolates and gift vouchers from clients but the notes and cards are the most special. I've kept every one of them.

"Think positive thoughts" - the simple but oh so complex advice from our son's teacher in preparation for NAPLAN this week. It got me thinking that it is worthwhile knowing what encourages you to think positively so you are prepared when life gives you lemons. The simpler the better - you won't know what challenges you'll face in the future. What do you know gives you a lift? I'll start - curling up in winter jarmies sipping coconut tea.

Queensland Law Society

There are already means of extending the usual three year limitation period to child sex abuse compensation claims but they do not always apply. Removing the time limit would improve equity and reduce costs.

Our school fete is on this weekend. It is always such a wonderful community event. I was reminded today of how anxiety provoking liability risk is for not for profit organisations when organising big events like this. If you are in charge of a major community event, make sure you:- 1. Conduct a thorough risk assessment of every activity and venue; 2. Check your insurance cover. Many standard public liability policies have exclusions for events with more than a very modest number of people. 3. Check the insurance cover of all contractors and venues. They should all have public liability and product liability insurance. I have advised community organisations about their insurance needs on a pro bono basis so please do not hesitate to contact me if you have any specific concerns.
