This morning we lodged urgent proceedings in the High Court against a decision of the South Eastern Health & Social Care Trust arguing that their decision was procedurally and substantially in breach of the European Convention on Human Rights. This afternoon, in a special sitting in the High Court, our client was vindicated when the presiding Judge made a declaration that the Trust's decision was unlawful and in breach of our client's Article 6 and Article 8 rights of the Convention. #Protecting the rights of individuals

Today we lodged papers in the High Court for leave to apply for a judicial review of a decision taken by South Eastern Health and Social Care Trust. Calculating Strike Pay A significant victory for teachers in the UK Supreme Court yesterday. In 'Hartley v King Edward VI College' - the Court held unanimously (in absence of contract specific conditions) that during lawful strike action, teachers should have pay deducted at a rate of 1/365 per day. This overturned the Court of Appeal judgement and rate of 1/260 which the College had argued was reflective of their 'actual' working days. In arriving at this decision the Supreme Court considered the evidence from the teachers that demonstrated that their work was not limited to time teaching and they regularly performed their duties during evening, weekends and/or days of annual leave. Whilst the above is a fact specific decision applicable to teachers, the principle may be applicable to other employees whose days of work are not ascertainable.
Hugely significant ruling today for disability discrimination law in the context of NI legislative divergence. Associative Discrimination falls under the protections of DDA. You cannot be treated less favourably in work as a result of caring responsibilities for a disabled child.
