The House of Lords is proving to be defiant in trying to delay the Brexit Bill even though the Government is still pushing ahead with invoking Article 50. One source has reported, "One unmade Cabinet minister said peers would bring “an existential crisis upon themselves” and sign their own death warrants." The full article can be read at: https://goo.gl/657TRn The main thing which will effect our clients is the change in free movement of people from the EEA States. Currently many European Nationals and their Non-EU Family Members have had their applications to stay in the UK met by a bureaucratic wall which Brussels stated will be investigated. We have seen many applications made under the EEA Route still pending because of the Brexit issue even though in the past they would have been decided by now. It is yet to be seen how the Government will announce changes that effect EEA Nationals and their family members in the UK. Further there will most likely be changes to how European Nationals who are in the UK can extend their leaves and how businesses who employ EEA nationals may need to have some form of work permit or sponsor licence checks in place like you do if you need to have people from outside of the EEA work for you in the UK. If you are a European National or a Family Member of a European National who needs to apply for Permanent Residence or a Residence Card we would advise that you do so before 15 March 2017, that seems to be the date the Government has set as the cut off date, any applications after that may be subject to new rules which are not yet known. May 'to end EU citizens rights to live permanently in UK within days'

As always the Government never lets you down... "Theresa May reportedly plans to end rights given to EU nationals under freedom of movement rules when she triggers Article 50 next month, with a Government source claiming that otherwise “half of Romania and Bulgaria” might come to the UK before Brexit." It appears as though anyone who comes to the UK after 15 March 2017 will not be allowed to remain here in accordance with the The Immigration (European Economic Area) Regulations 2006, therefore any new migrants coming to the UK from the EEA area will need to meet requirements under the new rules that will govern their entry to the UK. Income rules for foreign spouses upheld - BBC News

So the #mmcase ruling confirms that the income threshold stands (for now) but that treatment of alternative income and children is unlawful. The main thing to take away from this is the instructions that have been given to the Secretary of State for the Home Department to provide her position on what will she do about the rules/instructions to bring them in line with the courts findings. Families await supreme court verdict on income rules for spouse visas

***NEWS & UPDATE*** It is a huge day at the Supreme Court tomorrow, many families like our clients, will be waiting to hear the outcome of the now infamous £18,600 threshold legality. The £18,600 amount was a key test that came into force in July 2012 and since then has kept many families apart because they could not meet the financial requirements. Driving licences of thousands of 'illegal immigrants' revoked - BBC News
