European Commission consults on FinTech regulatory framework

European Commission consults on FinTech regulatory framework FinTech should be able to offer solutions to increase cost efficiencies, address users' complex needs and generate value for the economy, but in order to deliver, appropriate policies on important issues, such as access to technology, data standardisation and security, personal data protection and data management, need to be put in place. As part of the Commission`s Digital Single Market Strategy for Europe, it has issued a cosultation document to clarify its stance with regards to FinTech. If you are intersted, you are invited to reply by 15 June 2017 at the latest to the online questionnaire. I`ve read through the paper and the questions raised are quite interesting and challanging. Robots: Legal Affairs Committee calls for EU-wide rules | News | European Parliament

I,Robot - IP owner! Robots to become an independent category of legal person, with capacity to create and own property -On January 12, 2017, The European Parliament approved a draft resolution on robotics and artificial intelligence (AI) “A robot may not injure a human being or, through inaction, allow a human being to come to harm.”….You remember Asimov`s Law? Well, this might be reality sooner rather than later. A draft resolution, prepared and approved by the European Parliament’s Legal Affairs Committee, takes a radical approach. It addresses IP rights in robots/AI`s creation and the possibility of introducing a new legal status for some autonomous robots. Next to legal questions re IP ownership and liability, the resolution also deals with ethical, safety and changes in the labour markets. This is great news (for IP lawyers). It is not not often that lawyers are getting excited. I can`t wait to hear more about this. The European Parliament will further discuss the resolution in February. There are so many questions linked to this topic, I do not even know where to start (yet). But I will get back to you on this one shortly. The European Commission has published guidelines for SME on the security of personal data processing. The book is available for free and a great basis to start from. The General Data Protection Regulation (EU) 679/2016 (‘GDPR’) will be effective as of 25 May 2018. Time to roll up the sleeves and start working on this... EDÖB - Swiss-US Privacy Shield: neuer Rahmen für Datenübermittlungen in die USA

Der Bundesrat hat an seiner heutigen Sitzung von der Einrichtung eines neuen Rahmens für die Übermittlungen von Personendaten aus der Schweiz in die USA Kenntnis genommen. Der sogenannte Privacy Shield ersetzt das vom EDÖB für ungenügend erklärte und nun auch vom Bundesrat formell aufgehobene Safe-Harbor-Abkommen zwischen der Schweiz und den USA. Datenschützer schliesst Sachverhaltsabklärung zu Windows 10 ab

Der EDÖB hat die Sachverhaltsabklärung zum Betriebssystem Windows 10 von Microsoft beendet.
