My weekly Blog - Must read February 9, 2016 Some Toronto area schools in need of repairs Each day parents throughout Ontario send their children off to school to learn. Few, if any, likely spend much time worrying about whether the school environment is safe. While much of the time this is the case, there are times where a child could be hurt. The parents of a Grade 2 student at a Toronto area school know this all too well. The girl, who attends Earl Beatty Junior and Senior Public School, was hurt when a broken bathroom stall door fell on her and pinned her. The door allegedly fell when another student pushed it open and it came off the hinges. In the accident she received a concussion. The concussion recovery time will vary depending on the individual who suffers it, as well as the severity of the injury. In this particular situation the girl’s mother indicated it took two months. She said the 6-year-old had difficulties concentrating, sleeping and eating. The incident shines a light on an issue that many schools in the area face—providing a safe learning environment. Children are not the only the ones who are being hurt at schools in Toronto. According to the president of Elementary Teachers of Toronto, elementary teachers in the Toronto District School Board’s schools report injuries of varying severity almost every day. Anytime someone is hurt as the result of the negligence of another party, it may be possible to recoup financial compensation. In this case a premise liability lawsuit may be appropriate. Law designed to protect pedestrians in Ontario now in place As residents of Ontario are likely well aware, pedestrian accidents are an issue. When someone who is walking is struck by a vehicle the injuries inflicted can be devastating. Likely in an effort to reduce the number of these incidents that occur, the province recently passed a new law regarding crossovers. That law went into effect at the start of the year. The law is specifically designed to keep crossing guards, pedestrians and schoolchildren who are crossing a street, safe. Now, when a driver comes upon a school crossing zone or crosswalk with lights, he or she must wait until the pedestrian has left the road completely, before they can proceed. Individuals, who fail to comply with the new rule and are caught, could be fined. While the fine could total between $150 and $500, if the driver is caught breaking the law at a school crosswalk, the amount could be twice that amount. Just how well police officers will be able to enforce the law remains to be seen. It is also unclear whether fewer pedestrians will be hurt in crashes as a result of the law. Regardless of the existence of the law, pedestrians who are hurt in an accident of this nature, or the family members of those who die, may be able take legal action against the driver of the car. Could addressing these issues make Toronto safer for pedestrians? Each day people throughout the greater Toronto area take to the streets in their vehicles. Relied upon by many to get from one place to another, much of the time they interact without any problems. There are times however when this is not always the case. When vehicles collide with pedestrians, those individuals could be seriously injured. There are many reasons why these accidents occur. Recently, experts offered several ways in which the number of these accidents that occur, could be reduced. The first involves pedestrian accidents resulting from cars making left-hand turns. To reduce the number of these incidents that occur it could make sense to prohibit those turns during the times of day when pedestrians are likely to be crossing the street. Another alternative could be to improve the signage in the area. The second issue that could cause a serious accident on Toronto roads is heavy trucks. Pedestrians and cyclists are sometimes killed when they collide with the side of these vehicles. Some believe making side guards on those trucks mandatory, would make a difference by keeping those individuals from getting under the wheels of the truck. Another issue is vehicles traveling too fast. Speed plays a role in how serious a pedestrian’s injuries are following a crash. The fix for this is simple—reducing the speed limit on roads throughout the city. Distracted drivers could also result in pedestrian accidents occurring. Whatever the distraction, educating both drivers and pedestrians about the dangers of not focusing on your surroundings, could make a difference in the number of pedestrian accidents that occur. Last, accidents of this nature could occur when pedestrians cross the street in the middle of a block, rather than walking to the corner. Installing more mid-blocking crossings could be used to combat this issue. Tips for staying safe while driving this winter Icy roads are a part of winter in Mississauga. Because they can be dangerous, it is important that drivers venturing onto area roads, that are slippery because of the ice, take precautions to keep themselves and others safe on the road. The key is to make sure that vehicles are able to stop in enough time to avoid striking other vehicles or objects. The best way to stop a vehicle is to drive at a speed that makes it possible for the vehicle’s tires to grip the pavement. The faster a vehicle is travelling, the harder it will be to stop. Because of that, in slippery conditions the slower the speed, the better. There are other things that can be done to make driving safer during winter. The first is to stay home when road and weather conditions are too harsh. Being aware of landmarks and signs while travelling in areas that are unfamiliar is also a good idea should it become necessary to call for help. Other things involve preparing the vehicle for winter weather. In addition to having a car serviced to prepare for the season, making sure there is another windshield washer fluid and that the windshield is properly cleared for ice and snow is necessary. Likewise, the headlights should be cleared off and in good working order. Creating and placing a winter survival kit with food and beverages, flashlights and blankets is also wise. Following these tips could keep drivers in Ontario safe throughout then winter. Should an accident occur that results in injuries, it may make sense to consult a personal injury lawyer for information regarding filing a personal injury lawsuit. Pedestrian accidents an issue in Toronto There are many things that drivers need to be aware of when driving on roads in the Toronto area. While other vehicles are likely the first thing that comes to mind, they are by no means the only other objects that need to be looked out for. In some situations pedestrians interact with cars as well. Drivers should always keep their eyes out for these individuals. There is good reason for this. When a pedestrian is struck by a car, the injuries inflicted can be devastating. The force of the impact can cause serious injuries or even death. The number of pedestrians who have been hurt or killed in Toronto, in an incident involving a vehicle, is up this year. In the first 10 months, a total of 1,513 people were struck. Of those individuals, 34 died. That is 90 percent more than 2011 when 18 pedestrians were killed in accidents. Some of the pedestrian accidents involved trucks. Recognizing this, some people believe that laws should be passed that require the installation of side guards on the large vehicles. The idea is the guards would keep pedestrians from becoming caught in the undercarriage, or from ending up under the wheels. Close to half of all pedestrian accidents involving trucks involve the person making contact with the truck’s side. The city of Toronto could pass a law to this effect if it so chose. Sometimes negligence on the part of a truck driver is to blame for these incidents occurring.
