Wills & powers of attorney | ASIC's MoneySmart

One of the more common forms of Elder Abuse is the misuse and misunderstanding of the powers of attorney from the abusers to the older person. With older Australians living longer, many have amassed assets from superannuation to property. Some adult children may go through 'inheritance impatience' to access their parents' assets. Abuse can mean strong pressuring, fraud or emotional exploitation. Find out more about powers of attorney, wills and trusts: http://bit.ly/1oR1AiQ

World Elder Abuse Awareness Day (WEAAD) is next week, 15 June. This is the day designated by United Nations General Assembly where we raise our voices in opposition globally to raise awareness and take action in solidarity with and support for the older members of our community. On this day, the Australian Law Reform Commission (ALRC) will launch its Report of the Australian Law Reform Commission Inquiry into ‘Protecting the Rights of Older Australians from Abuse’ at the WEAAD forum. They Suffer in Silence.

70% of cases of elder abuse is perpetrated by the child of the older person. This creates a debilitating dilemma for the older person where any form of legal or criminal action taken to protect themselves would undoubtedly destroy the relationship with their child, and potentially their grandchildren. This is why organisations like FMC Mediation and Counselling has been working with older people experiencing abuse to provide support and develop their ability to exercise self-advocacy in the process, through coaching, social support, counselling and other individual support services. Our Respecting Elders service encourages the older person to engage with supported conflict and dispute resolution services which aim to preserve the family relationships where possible. Our CEO Serge Sardo weighs in on Elder Abuse, and why it is critical to shed light to end the silence.
